Cancelled during surgery? (Photo)

I was supposed to have a MMO (ett, bl, lipo 360, bbl) but it was cancelled 30 minutes into it. He had performed 65% of the lipo only, before stopping bc my heart rate was low. They stopped surgery, understandably. I was told i needed cardio clearance, from his preferred dr. I did the stress echo and another test, and was cleared. I have a low hr no heart issues. They are giving me the run around on either a refund or reschedule, would i be entitled to a partial refund for srvc not done?

Hello, I am Dr Diego Fierro. I am sure that for your surgeon the most important thing was your safety so he decided to end your surgery because he thought something bad could happen, however what I can tell you from my work experience, I send all my patients to be evaluated by a cardiologist so that you enter safely to your surgery and I to operate. However, if you have low heart rates, you would have no problem in reprogramming as long as the cardiologist has studied you.

You will need to review all the paperwork you signed about payment and cancellation of surgery. Then, discuss your concerns with the office manager.  Every surgeon has his/her own protocol about cancellations and refunds. Some give no refunds.

Your case is interesting since your safety is Paramont and if during the surgery, there is a cardiac pulmonary or other issue that both the anesthesiologist and surgeon was to cancel for your safety. No fault can be laid. Was your surgery in a hospital as an outpatient in an ambulatory center or an office clinic? Also even with a surgical medical clearance does not mean you’re a safe candidate for surgery. This needs to be discussed in detail so best for a virtual or in person consultation. As far as refund that is between the contracts and consents you signed with the surgeon or clinic you were having the surgery performed again happy to virtual consult with you for better explanations regards.

Legal issues are best handled by legal experts.
You may have a good argument for a refund for services not provided.
A partial refund seems very appropriate and fair especially for all aspects of the procedure not performed.
I’m guessing it was the anesthesiologist. Call to stop surgery.
Did you have a low heart rate before the procedure?
If so, this should’ve probably been brought up and discussed with you.
Talk to your provider and see what they have to say.
As I mentioned legal issues are best handled by legal people.
Plastic surgeons are not trained in these matters.
