RealSelf Widgets Terms of Use

Your use of RealSelf Widgets is governed by the following RealSelf
Widget Terms of Use (“Terms”), which incorporates by reference the RealSelf
Terms of Service. By using any RealSelf Widget (“RealSelf Widget”), you agree
to be bound by these Terms and RealSelf’s Terms of Service (which can be
found at: http://www.realself.com/terms-of-service).

1. License Grant. Subject to the terms and conditions of these Terms,
RealSelf grants you a worldwide, non-exclusive, non-transferable, non-sub-
licensable right and license to download, access, and use the RealSelf Widget
solely for your use on your website.

2. RealSelf Widget Restrictions.
a. You may display the RealSelf Widget on your website but you may
not display the RealSelf Widget in any way that implies RealSelf is affiliated with,
sponsors or endorses you.
b. You may not display the RealSelf Widget on any website that
disparages RealSelf or any third party, infringes the intellectual property or
proprietary rights of RealSelf or any third party.
c. You may not decompile, reverse engineer, disassemble, modify,
rent, lease, loan, distribute, create derivative works or improvements from the
RealSelf Widget or any portion thereof, or attempt to discover any source code or
other trade secrets in any RealSelf Widget.
d. You may not sell, lease, sublicense, loan, distribute or transfer the
RealSelf Widget or use the RealSelf Widget in an unlawful manner, for any
unlawful purpose or in any manner inconsistent with these Terms.

3. Ownership of RealSelf Widgets. RealSelf owns all right, title and interest in and to the RealSelf Widget. All rights in the RealSelf Widget, including
any content or services provided therein, not expressly granted to you are reserved by RealSelf.

4. Support and Updates. RealSelf may not offer any technical or maintenance support for the RealSelf Widget and RealSelf may offer upgrades or
updates to the RealSelf Widget in its own discretion. In addition, RealSelf may
change, suspend, discontinue or terminate any aspect of the RealSelf Widget at
any time without notice to you. RealSelf may also limit your access to parts or all
of the RealSelf Widget without notice or liability.

5. DISCLAIMER OF WARRANTIES. YOUR USE OF THE REALSELF
WIDGET IS AT YOUR SOLE RISK AND THE REALSELF WIDGET IS
PROVIDED “AS IS.” REALSELF EXPRESSLY DISCLAIMS ALL WARRANTIES
OF ANY KIND, WHETHER EXPRESS OR IMPLIED, RELATING TO THE
REALSELF WIDGET AND ANY DATA, CONTENT OR SERVICES ACCESSED
THROUGH THE REALSELF WIDGET. REALSELF EXPRESSLY DISCLAIMS
THE IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY,
SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE AND
NON-INFRINGEMENT. These limitations apply to the fullest extent allowed
under the applicable law.

6. Indemnification. You agree to indemnify and hold RealSelf and its
executives, employees, agents and contractors harmless from any claim, action
or proceeding arising out of your use of the RealSelf Widget, your violation of
these Terms or your violation of any applicable laws or rights of any other person
or entity related to your use of the RealSelf Widget.

7. LIMITATION OF LIABILITY. REALSELF IS NOT LIABLE TO YOU FOR
ANY AND ALL DIRECT, INCIDENTAL, SPECIAL, INDIRECT, PUNITIVE OR
CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO THE
REALSELF WIDGET, ANY DATA, CONTENT OR SERVICES ACCESSED
FROM THE REALSELF WIDGET OR YOUR USE OR INABILITY TO USE THE
REALSELF WIDGET, WHETHER SUCH CLAIMS ARE BROUGHT UNDER ANY
THEORY OF LAW OR EQUITY. THE DAMAGES EXCLUDED HEREUNDER
INCLUDE, WITHOUT LIMITATION, THOSE FOR LOSS OF BUSINESS
PROFITS, INJURY TO PERSON OR PROPERTY, BUSINESS INTERRUPTION
AND LOSS OF BUSINESS OR PERSONAL INFORMATION. These limitations
apply to the fullest extent of the law in your applicable jurisdiction.

8. Termination. These Terms continue unless terminated by you or
RealSelf. You may terminate these Terms at any time by not using the RealSelf
Widget and removing the RealSelf Widget from your website. RealSelf may
terminate these Terms at any time if you violate these Terms or by providing you
notice of the termination of these Terms whether by written notice to you or
written notice posted on RealSelf’s website. Your obligations under these Terms
will survive their termination.

9. General Provisions. These Terms are governed under the laws of the
state of Washington without regard to its conflict of law provisions. Any conflict
arising from these Terms shall be decided in a state or federal court in King
County, Washington. You and RealSelf hereby agree to submit to the personal
jurisdiction of any state or federal court in King County, Washington. These
Terms are the entire agreement between you and RealSelf with respect to your
use of the RealSelf Widget. Notwithstanding anything to the contrary, you agree
that any claim or controversy arising from these Terms or your use of the
RealSelf Widget must be filed within one (1) year after such claim or controversy
arose or the claim or controversy will be barred forever. RealSelf’s failure to
exercise or enforce any right or provision of these Terms shall not constitute a
waiver of any of RealSelf’s rights.
