My doctor's office is refusing to give me my medical records. I spent $12,600 on rhinoplasty and a necklift.

Ultimately, you have every right to a copy of your medical record. It sounds as if the physician's office is having to deal with the tragedy that you described. I would give it some time to settle down. In the meantime, you certainly can see another surgeon for follow-up care who should be able to help you during the healing process even without your treatment records.

The simple answer is of course you have a right to your medical records. You also should have some access to postop care. Given the tragic circumstances that have occurred, the Surgeon's wife is likely to be in a fragile state.   I really believe that this can be worked out with time.  In the meantime, go and see another Surgeon for any concerns that you currently have.

Your surgeon's death is devasting to his family and staff. Please give time for them to get back to semi normal . You have legal right your have access to your medical record and try not make it a legal issue till all other option are exhausted.   

This does unfortunately occur. Most states require that a medical office turn over a copy of the patient's entire medical record within a reasonable timeframe (typically about 30 days) following your request. What would be most expeditious would be to again request your records and let the office manager know what your next step will be. Your next step would be to file a complaint with the Florida medical board. This should cost you nothing and can often be performed online. Unfortunately, you're all in a bad position as you need followup and I am sure the entire practice is grieving. You have a right to your review and obtain copies of your medical records in a timely fashion.  I would recommend discussing this with the office that provided your care.  If you do not get a positive response I would recommend filing a complaint with the medical board in the state where your care was provided.  Best wishes,Cody Koch
