By law does a PS have to keep pre-op photos of breast reconstruction with a patient's files?

Any photos taken before or after a surgical procedure are a part of the medical record. Some plastic surgeons have a separate consent for for photography. Others include it in the consent for surgery. They are protected by HIPPA laws.
Photographs taken during the consultation, after and during surgery are part of the medical records.The patient has the right to get copies of all the medical records including photographs.
