Is it acceptable to leave an implant (12 month old) in my jaw to heal over as he was unable to remove the broken crown screw?

The dentist thinks the crown screw broke (which he is unable to remove) because of poor manufacture and is sending it off to be analysed with the pretext to maybe refunding the cost of crown. He is letting the gum heal over the top of the implant and leaving it. This crown had to be screwed back in 3 times over the year before it broke. Should he be offering an implant removal and if possible replacement? I don't want to upset our relationship without first gathering some facts
