The physician has prescribed narcotic medications, on a limited bases, for himself and member of his staff without performing an adequate history and physical examination, diagnostic tests, making a diagnosis or developing a treatment plan. In addition, the physician permitted his staff to call prescriptions into pharmacies for patients of his practice and other staff members without established written protocols.
Upon being made aware of the deficiencies in his practice, the physician took immediate and voluntary remedial action to bring his practice into compliance with the statues and governing rules.
Action Taken
For the purpose of avoiding further administrative action, the physician entered into a Consent Agreement with the Tennessee Medical Board of Examiners in which the physician agrees to the following and not limited to the following.
•The physician’s Tennessee medical license # 369510 is Reprimanded.
•The physician is ORDERED to enroll in and complete the course ”Prescribing Controlled Drugs” and submit proof of completion to the Board.
•The physician is ORDERED to enroll in and complete the ”Intensive Course in Medical Records Keeping” and submit proof of completion to the Board.
•The physician must pay two Civil Penalties in the amount of $1,000.00 each for a total of $2,000.00.
•The physician must pay the actual and reasonable costs of prosecuting this case; said costs not to exceed $3,500.00.
The Tennessee Board of Medical Examiners takes the following action in order to protect the health, safety and welfare of the citizens of the State of Tennessee and ensure that the public confidence in the integrity of the medical profession is preserved.
