FMLA/Time off Question

By mommymakeover28 on 06 Sep 2012

I am having a Mommy Makeover on October 12th (yea!!) and had requested 2 weeks off.  I have 6 weeks of sick time so I didn't think it would be an issue but my boss came back and told me that I had to open up an FMLA case since it was more than 3 days off.  I know 'technically' FMLA can't be used for plastic surgery, but all three doctors have assured me that they have filled these out for their patients.  Has anyone ever had to do this?  Did you get denied or questioned about it?  My employer doesn't know the nature of the surgery (I just said I was having surgery and I work from home so no one would know anyway).  I'm worried about being denied and then I don't have enough vacation time to cover it all.  Thanks for any and all advice!

hi. I have seen the paperwork from my employer n they ask specific details that will give away the reason so I opted to not even ask for fmla. If u read my review I had issues regarding returning to work but now I have secured my position unitl 10/1 and I had surgery on 9/14. So every empoyers paperwork is different. n also my employer had me apply for their employer paid disability (Cigna) n they know if Im approved or not.

serious health condition" is defined as an illness, injury, impairment, or physical or mental condition that involves inpatient care or continuing treatment by a health care provider. so having this surgery does not qualify under serious health condition I have heard it qualify when a hernia is fixed.

I don't know the laws, but that seems strange if you have the vacation time to make you open an FMLA case. Here's what some doctors say about FMLA. I hope some other ladies chime in here to give you some first hand accounts of how they handled this.
